Music industry lashes out at Kazaa trial

"Kazaa is an "engine of copyright piracy to a degree of magnitude never before seen," Tony Bannon, an attorney for the music industry, said during Monday's start of the Australian trial against peer-to-peer software distributor Sharman Networks."

The Sh*%t has hit Kazaa

Major record labels Universal Music Australia, EMI, Sony/BMG, and others are suing Kazaa for what they claim is a breeding ground of illegal music swapping all thanks to the software produced by software distributor Sharman Networks.

Sharman Networks says that it is not liable for what its users do with the software and has no intentions of the software being used as a music copyright infringement aid. The company claims that it has developed the software for other means of p2p usage. However, within minutes of a Google search, first three results showed a search for 'Kazaa' listed as "free mp3 downloads". The trial is only scheduled for a three - week time frame, but in all honesty we know it will take much more time than that!

"The events at last night's game were shocking, repulsive and inexcusable -- a humiliation for everyone associated with the NBA. This demonstrates why our players must not enter the stands whatever the provocation or poisonous behavior of people attending the games. Nozmo King (Nozmo King Records). Formed in 1997 at Ithaca College, Nozmo King demonstrates on Second System that jazzed-up rock is alive and well...Nozmo's polished and precise horn arrangements serve a rather complex deconstructionist vision that's part modern and part classic.
Propelled by the progressive jazz-rock drumming of Aaron Jackson, Nozmo King skews its sound toward that of mainstream horn-and-harmony groups such as Earth, Wind and Fire...They also give a nod to contemporary funk-rockers such as the Red Hot Chili Peppers or Dr. Pocket.

On "Butterfly," however, keyboardist Aaron Velardi pumps out a classic Memphis soul organ riff, leading the listener to expect a knockoff of Booker T and the MGs. Yet this butterfly unexpectedly turns into a string-laden soul ballad, then becomes a soulful strut that sets up a powerful jazz explosion featuring saxophonist Mike Walls.

Lead singer Josh Keller wrote "Butterfly," and it features a complex song structure that might leave some pop music fans scratching their heads. Without the sharp-as-tacks musicianship, such complexity might indeed prove deadly, but Nozmo pulls it off as a tour de force of progressive funk and jazz.

John Brown's Body vocalist Elliot Martin makes an appearance on "Higher," a Nozmo original that borrows a bit from the traditional "Swing Low, Sweet Chariot." The band builds upon the standard, giving it a jazz-inflected feel. Trumpeter Dave Szebeda delivers a solo worthy of the spotlight. Szebeda also adds a haunting horn introduction to the ballad section of "Acting Out."

The Black Amex Legend : The Centurion card


"American Express, a company dogged for years by a rumor that it handed out black AmEx cards entitling holders to purchase anything up to jet fighters and beyond. While people insist a few of those fabled cards were provided to the ultra-privileged (those who had millions of dollars in American Express bank accounts; Imelda Marcos and the like) from 1984 to 1987, and a 1988 Wall Street Journal article appears to support that claim, whatever the truth about those chargeplates of lore, in 1999 the corporation finally bowed to the belief and began openly offering a real card at least somewhat in line with the rumor.

In 1999 American Express announced the introduction of its Centurion™ card. Available only by invitation to selected Platinum card members, this black credit card promises to simplify the lives of the harried rich. In exchange for its hefty annual fee (initially $1,000 US, but now $2,500), cardholders receive automatic upgrades on fifteen of the world's leading airlines. They also receive assistance in securing hard-to-come-by tickets for popular events, reservations at trendy restaurants, and shopping for Christmas gifts. Someone from the service will even call to remind cardholders of upcoming anniversaries. It is akin to having a personal concierge always on call.

"There had been rumors going around that we had this ultra-exclusive black card for elite customers," says Doug Smith, director of American Express Europe. "It wasn't true, but we decided to capitalize on the idea anyway. So far we've had a customer buy a Bentley and another charter a jet."

Other card member tales:
One cardholder wanted to locate and purchase the horse ridden by Kevin Costner in Dances with Wolves. The horse was located in a stud ranch in Mexico, purchased and delivered to Europe.

Another cardholder wanted a handful of sand from the Dead Sea for a child's school project on the Holy Land. Someone was dispatched by motorcycle to the shores of the Dead Sea to obtain the sand, which was couriered back to London.

Yet another cardholder required American Express to organize a wedding, including designing the wedding card, drawing maps to direct guests to the banquet, renting tuxedos and shoes for guests, and preparing the hotel room with a jacuzzi for the wedding night.

And for another cardholder who aspired to be an actress and wanted to be part of the crew of a weekly soap opera on TV, American Express contacted the director and arranged for an audition.

According to cardholder and record producer Nellee Hooper, the Centurion "arrives at your house with a security guard. You get this big, black, velvet-lined box, with a special mini-computer and two black cards in it, one for business, one for pleasure." If you put your card in the mini-computer, it tells you how much you've spent.

Yet for all of its snob appeal, the Centurion is still a thing of mystery. Though we located numerous references to it on the American Express web site, nothing we came across explicitly outlined its eligibility requirements or benefits. The card cannot be applied for; it is either proffered by AmEx or it is not. As to how the company decides whom it should offer the preferred plastic to, according to American Express their applications for Centurion cards are generally provided to customers who annually charge $150,000 or more to other AmEx cards. Centurion cards are not offered to anyone who has been a cardholder for less than a year.

Black charge cards have progressed from the realm of urban lore into reality.

Given the annual fees attaching to such premium cards and in light of the interest rates they carry, we're quite content with our less dusky plastic." [Via Snopes.com]

Rapper O.D.B. dies at recording studio


"NEW YORK (AP) -- The rap artist O.D.B., whose utterly unique rhymes, wild lifestyle and incessant legal troubles made him one of the most vivid characters in hip-hop, collapsed and died inside a recording studio Saturday. He was 35.

O.D.B. had complained of chest pains before collapsing at the Manhattan studio, and was dead by the time paramedics arrived, said Gabe Tesoriero, a spokesman for O.D.B.'s record label, Roc-a-Fella.

The cause of death was not immediately clear, but O.D.B. had recently finished a prison sentence for drug possession and escaping a rehab clinic. He would have turned 36 on Monday.

O.D.B. -- also known as Ol' Dirty Bastard, Dirt McGirt, Big Baby Jesus or his legal name of Russell Jones -- was a founding member of the seminal rap group the Wu-Tang Clan in the early 1990s.." [Via cnn.com]

Supermodels to share their Secret

[Hollywood News]: London, Nov 11 : Supermodel Gisele Bundchen is all set to woo fans across America as she will join four other supermodels including Tyra Banks and Heidi Klum in a nation wide tour to promote 'Victoria's Secrets' latest lingerie collection.

The beauties will travel to a number of American states in a bus which will have the slogan 'Angels Across America' splashed across it along with the images of the models wearing items from the collection.

An Open Letter to Western Men - By, Gregory Concord

Dear Male Traveler,
Please heed my advice- DO NOT date the Vietnamese women. Unless you plan on taking one as a bride, do the women a favor and leave them alone. It will not turn out good.

Yes, they are very beautiful. Yes, they are extraordinarily sweet and innocent. Yes, they will wait on you hand and foot. And yes, they are sassy with Western men. DO NOT be fooled. These are not girls interested in a good time or a hot night. In fact, these ideas are as appalling to them as a nude beach or an all-night drinking binge. These are women who desire a husband, for richer or poorer, that they can follow to the end of the earth, cooking and cleaning and baring children. Not to say that is all they are capable of, but this is what their culture instructs them to be. And this is a culture they are not going to escape for a long time.

Opposite sex relations is very traditional in Vietnamese culture. Men and women remain largely separated from each other and are often seen holding hands and affectionately petting members of the same sex only. Courtship is quick and marriage the sole point of dating. What we would consider a “crush” is overwhelming love in their eyes. And, as a result of repressed sexuality, their fantasy life leaks into their real life and they often cannot tell which is which. So, while you may be enjoying the attentions of a delicate flower, they are most likely dreadfully and fatally caught up in a in Prince Charming fantasy in which you will whisk them away from their small village like some Cinderella story and take them to the magical Kingdom of the West. Their hopes for their future are placed solely on a dream, but it is no dream for them. And when you inevitably leave , as you always do, you leave behind a flower so crushed that it could severely damage her daily life. Plagued by images of you courting more beautiful Vietnamese women, she will not be able to concentrate on work and will be severely reprimanded by her ogre boss. Or, caught up in daydreams about the time you where there, she will cheerlessly traverse down the same roads you walked down together , (although in reality you never walked down them together because that would be wrong. You actually had to trail 10 feet behind her to make it proper) she will absent mindedly walk these avenues putting herself in harms way as the motorbike traffic dodges the cheerless dreamer.

Have you ever been to a wildlife preserve and a conservationist sternly warns you not to feed the wild animals? He is not saying this because he is a mean, green tree hugger. It is because your food is foreign to the animals’ stomachs and can give them digestive problems. You have bacteria on your hands that they have no natural immunity to and it can be fatal to them. Or, even worse, you may make them bold and brash around humans so that they venture further and further into people’s territory, eventually leading to their destruction when they are deemed ‘dangerously inappropriate.’ Well, think of Vietnam in much the same manner. From dating the women to over-paying beggar children- you can’t imagine the repercussions. But they are there, they are very real, and they will be repercussing long after you haul your sorry ass out of town.

Although you may be reading this, you may already be thinking how it won’t happen to you, how you can avoid these same issues. Well, you can’t. While you, in the end, at best might leave town with a dreamy heart and fond memories, you will inevitably leave behind a girl who will wait for your return until the end of time, or a heart so broken that it would be like crushing a newly blossomed flower. And if you think maybe you will at least hook-up for a night - forget about it. Not gonna happen. You can’t even walk down the street next to your partner at risk of them being labeled a whore for as long as they live in that town, which will be forever since they are too poor to ever leave .

So, unless you plan on taking her to the alter, don’t take her to dinner. And if this is still not enough to convince you to look but not to touch, picture your worst, most heart-wrenching breakup ever. Remember that psycho ex-girlfriend who somehow became your girlfriend without you knowing when or how? And when you try to kick her to the curb her pained look haunts you in your sleep. She will find you and recount your broken promises one by one. And while you don’t remember actually making these promises, she will almost convince you that you did actually say it, twisting your every word into a slipknot. And as you try to talk yourself out of it the noose only gets tighter and tighter.

Look, I am not innocent here. Obviously I am talking from experience. But I am regretful. So, heed me now- although the fruits of temptation may lay low in Hoi An, the lotus blossom floats delicately down the Mekong, the apples of desire lie deliciously all around Ho Chi Minh the taste is not as sweet as imagined and it will linger for a long long time in the mouths of all parties involved.

The iTunes Music Store has released a FREE 25 minute "mix tape" track. The folks at iTunes have declared November to be "Hip/Hop History Month" and are offering this track to help celebrate. Monster announces iCruze

"Monster and SoundGate have announced the iCruze, a car stereo interface for the iPod that doesn't require a particular head unit, cassette adapter, line-in, FM transceiver, or witchcraft. Utilizing existing CD-changer or satellite radio connections on your current stereo (assuming you have said connections), the iCruze allows you to control and play your iPod with a direct-line connection for what we imagine will be some great sound quality. It will list for $200, and they're also selling an optional display device to show song and artist info. While the price isn't great, this solution allows you to keep your current stereo head unit and forego all those crappy-sounding FM transceiver options." [Via Engadget]
